The Northwest Arkansas Community College Board of Trustees will meet TONIGHT to vote on a resolution to opt out of Act 226, which allows college employees and staff in Arkansas to carry concealed guns on campus, as long as the carrier is licensed. The board is getting pressure from the college staff leaders to keep the campus gun free. NWACC administrators have recommended that the school’s Board of Trustees opt out of the legislation and post signs in all entrances noting that concealed handguns are prohibited.

The recommendation and attached resolution that the administration sent to the Board of Trustees is shown at the bottom of this email. The resolution is signed by NWACC President Becky Paneitz, Faculty Senate President Bryan Aguiar, Staff Council President Lenora Sotlar and Student Government Association President Jesse Pierce. RESOLUTION ON THE CONCEALED CARRY OF HANDGUNS ON CAMPUS BY TRAINED AND LICENSED STAFF ON CAMPUS

WHEREAS, Northwest Arkansas Community College (NWACC) is a public institution of higher education that receives regular budgetary support from the State of Arkansas, and that is required to report to the Arkansas Higher Education Coordinating Board, and

WHEREAS, it is unlawful for any person other than a law enforcement officer or a commissioned officer in the employ of NWACC to knowingly carry or possess a loaded firearm or other deadly weapon in any publicly owned building or facility, and

WHEREAS, a “staff” member means a person who is not enrolled as a full-time student at NWACC, and is either employed by NWACC full time or is on a nine-month or twelve month appointment at NWACC as a faculty member, and

WHEREAS, Act 226 of 2013 requires that the Board of Trustees at NorthWest Arkansas Community College approve a policy with regard to the carry of concealed handguns on campus by trained and licensed staff members who possess a concealed carry permit.

NOW, THEREFORE, BE IT RESOLVED:

• That the Board of Trustees of NWACC adopts this policy expressly disallowing the carrying of a concealed handgun by staff members in college owned or controlled buildings and grounds, and
• That this Board policy expires one (1) year after adoption and must be readopted each year by the Board of Trustees at their annual meeting in January to remain in effect, and
• That NWACC’s commissioned law enforcement officers employed within the NWACC Department of Public Safety are exempt from this policy, and
• That NWACC’s Administration will conduct an annual analysis of its capacity to provide a safe and resilient environment that enhances the learning experience and supports the College’s educational mission, and
• That this analysis will accompany future requests to either readopt this policy or to adopt differing policies for the carrying of a concealed handgun by trained and licensed staff members for different campuses, areas of a campus, or individual buildings of the college for which the Board of Trustees is responsible, and
• That NWACC will post at the entrance of all facilities and parking lots controlled or owned by NWACC clearly written notifications readable at a distance of not less than ten feet that

Representative John Burris will be the guest speaker for the May meeting of Conservative Arkansas. He will address expectations regarding healthcare and taxes as a result of recently approved legislation. Burris currently serves in the 89th General Assembly as the Chair of the House Public Health, Welfare & Labor Committee and was a key designer in the Private Option legislation that just passed both the House and Senate.

He is currently serving his third term in the Arkansas House of Representatives. He represents District 98, which encompasses part of Boone County. In addition to chairing the Public Health, Welfare and Labor Committee, he is also a member of the Joint Budget Committee, the Joint Committee on Energy, the House Management Committee, the House Committee on City, County, and Local Affairs, the House Select Committee on Rules, and numerous subcommittees.

During the 88th General Assembly, Rep. Burris was the vice chair of the House Agriculture, Forestry and Economic Development Committee, where he chaired the Subcommittee for Parks and Tourism. He also served on the Arkansas Legislative Council; the committee for Legislative Joint Auditing; the Joint Energy Committee; and the House Revenue and Tax Committee. He served as House Minority Leader during the 2011 Regular Session and 2012 Fiscal Session; the youngest Minority Leader in state history.

For the 87th General Assembly, Rep. Burris served on the House Public Transportation Committee, and the House Committee for City, County and Local Affairs. He is a graduate of Arkansas State University and lives in Harrison.

Burris’s work in the legislature earned him a spot in the Arkansas Business Journal’s 2009 list of the top “20 in their 20′s”. His legislative philosophy is “As a legislator, you can’t change the world, but you can help people one at a time.”

To summarize very briefly, one option was to do nothing, or perhaps to nullify the ACA. In other instances where states have done this, the federal government has asserted that it will institute the provisions of the ACA through federally-managed Medicaid expansion without the state’s assistance or input.

The other option was to use the leverage afforded by the SCOTUS decision to put a solution in place that would divert those same Medicaid funds into a private individual insurance market based on free market principles, with the overall goal being to preserve as much individual freedom and state influence as possible, and to reduce overall healthcare costs for all Arkansas citizens. This route also shrinks Medicaid as it moves qualifying applicants from that program into the private market. However, to clarify potential confusion, the private option is ironically what many in opposition are referring to as de facto “Medicaid Expansion”.

As an organization, Conservative Arkansas considered whether to publicly announce support for a position. Given both the complexities of the issue and the division that seemed to be brewing among conservatives, the board did not reach a confident consensus specific to making a public endorsement. As individuals, of course, board members are still free to weigh in on any discussion with their personal thoughts, and likewise, our Executive Director advised our friends in the legislature that Conservative Arkansas would not hold their vote against them in either case. Especially in light of the exciting struggles and strides they made for conservatism, most notably the sanctity of life.

Despite our own deliberate attempts to keep the debate civil and productive, we believe that our membership should be mindful of those more inclined toward a destructive or contentious approach and that we rebuke any such sentiments or tone from either standpoint. We simply encourage our membership to continue to learn more about the assorted issues affecting our healthcare, and we look forward to providing genuinely constructive opportunities in that regard.

A sixth-generation Arkansan, Tom Cotton was born and raised in Dardanelle on his family’s cattle farm. Tom graduated from Dardanelle High School and went on to graduate with honors from Harvard College and Harvard Law School.

After completing law school, Tom clerked for the U.S. Court of Appeals and then entered private practice, where he concentrated in labor, employment, and constitutional law in cases at all levels of state and federal court.

Yet ever since the September 11 attacks, Tom had felt called to serve his country in uniform, and he ultimately left his law practice to join the Army. Tom declined offers for a direct commission as an Army JAG, volunteering instead to serve as an infantryman. Tom spent five years on active duty. He deployed to Baghdad in 2006 as a platoon leader with the 101st Airborne. In Baghdad, Tom was responsible for a 41-man air-assault infantry platoon and planned and led daily combat patrols.

Following his Iraq deployment, Tom was assigned as a platoon leader at The Old Guard at Arlington National Cemetery, where he was responsible for conducting military honors funerals for veterans from World War II to today’s war. In 2008, Tom volunteered to return to the front lines and deployed to eastern Afghanistan as the operations officer of a provincial reconstruction team, where he planned and resourced daily counterinsurgency and reconstruction operations for an 83-member joint and interagency team.

Tom’s military decorations include the Bronze Star Medal, Ranger Tab, Combat Infantryman Badge, Parachutist Badge, Air Assault Badge, Afghanistan Campaign Medal, and Iraq Campaign Medal.

Following his active-duty service, Tom worked as a management consultant for McKinsey and Company. As a businessman, Tom has advised some of America’s most respected companies on business strategy, operations, finance, and marketing. His industry experience includes agribusiness, health care, oil and gas, food processing, insurance, and aerospace.

Tom has appeared on numerous television and radio programs as an expert with firsthand knowledge of America’s policy in Afghanistan. These appearances include Fox & Friends, Larry King Live, CNN American Morning, The Hugh Hewitt Show, and The Laura Ingraham Show.

As you would expect, the Teacher’s Union is opposed to this bill, but the most powerful group against it is the Superintendent’s organization. They are the ones putting the most pressure on the legislators who might otherwise vote for it. BUT IN A SURVEY LAST FALL, 74% OF ARKANSANS SUPPORT SCHOOL CHOICE! It’s time we remind these public servants that we don’t want our state education system to be a jobs program for teachers and staffs and administrators, but rather we want it to EDUCATE our KIDS! Below are the activities that we need your help to complete. Please do any and all that you can. Every bit helps!!!

1. Absolutely BURY the members of the committee with calls, letters, e-mails, Letters to the Editor, public endorsements, etc. AND DO THE SAME THING to all the superintendents out there, as well as their state organization. There is a link at the bottom of this email to help you contact all legislators on the Education Committee with one click. It can’t get any easier than that!

2. We need people to show up at the committee hearing: so many that everyone cannot get inside the room. Our side needs to show up early so we can get in. We especially need you if you are a constituent of one of the Education Committee members. If you are, please call your representative and tell them how important this is; tell them you will be at the hearing, and make sure you go up to your representative BEFORE the committee meeting to introduce yourself, tell them how important this is to you and your children and then sit where your representative can see you during the meeting. There’s nothing like direct accountability to make a representative think twice about voting differently than his constituency desires.

3. There will be a rally to support School Choice in the rotunda of the Capitol at 9 a.m.-9:30 a.m. on Tuesday, April 2nd. We need a LARGE, NOISY crowd so that legislators can see and hear it as they head into the building. Everyone is asked to wear a bright yellow t-shirt and make a homemade sign. After the rally, the group will head to House Education Committee in Room 138 by 10:00 am. Once the legislation has been voted on, everyone is invited to gather downstairs for the Conservative Caucus Luncheon in the Capitol Café for lunch (usually $5, CASH only).  The group will eat together in the back room and will hear from Ben Evans of the Heritage Foundation-Heritage for Action, from noon – 1 p.m. and some  legislators.

Big River Steel has proposed building a $1.1 billion electric arc furnace steel mill in Mississippi County in NE Arkansas. Big River Steel has proposed building a $1.1 billion electric arc furnace steel mill in Mississippi County in NE Arkansas. The proposed plant will be located on a 1,140-acre site about seven miles SE of Osceola. They say they will create 525 full time jobs.

However, just 30 miles up the road, there is Nucor Steel. Nucor has two plants, the first built in 1988, which together employ over 900 people. Nucor is also the only A-rated steel company by both Moody’s and S&P.

Is it a good idea to have two steel mills in Arkansas, within 30 miles of each other, competing for raw materials, energy, labor, rail car, and truck transportation? Wouldn’t adding more production via a second mill affect the selling price of the final products and result in a lower overall profit margin? Nucor currently operates at about 70% capacity and has been in that range since 2008 due to recession and international competition. They have paid over $2 billion of direct and indirect taxes into the state treasury during the 25 years they’ve been in business in Arkansas. And Nucor got NO loans from the State to build their plants in our state.

If BRS is built, they will need not only labor, but also rail cars and trucks to transport their products. Adding this second mill will increase competition for those providers, thus likely driving up costs, and thus increasing selling prices for both BRS and Nucor — in a an already unfavorable steel market.

US companies have already been exporting a substantial portion of their product, but the Chinese have expanded production dramatically. The Koreans have done it, and it is believed that the Russians have as well. There’s more than enough capacity and we’re losing on the export market.

As an example, RG Steel was the fourth largest flat-rolled steel company in the US. They went bankrupt. Mills were closed in Maryland, Ohio, and West Virginia. Four thousand steel jobs lost. RG Steel was a casualty of falling steel prices and oversupply in the US, (Reuters). Excess capacity is one of the main risk factors facing the global industry today. Slim margins already exist in the steel industry due to foreign competition. Globally there was 542 million metric tons of overcapacity in 2012 and it is forecasted to be even higher in 2013. It is expected to take five-seven years to work off the surplus capacity.

Since it doesn’t look like a rosy future for steel plants, putting two of them within 30 miles of each other won’t help matters. And if BRS can’t turn a profit, how does Arkansas get its investment back? BRS will probably come back to the state, needing even more money.

Amendment 82 of the Arkansas Constitution enables the General Assembly to authorize the issuance of general obligation (GO) bonds to attract large economic development projects having a minimum investment of $500 million and creating at least 500 permanent jobs with an average annual salary of $70,000. The Governor and the Arkansas Economic Development Commission wants our legislature to approve an economic incentive package that will cost $125 million in GO bonds as a low interest loan to Big River Steel.

The sheet metal industry has been running about 70% of capacity for well over four years. Their profits have been squeezed. And with a slow economic recovery, if this is a recovery at all, there doesn’t seem to be a turnaround anytime soon.

A consultant hired by the Legislature released their report Friday, March 22: “The large investments and operations do generate jobs, but the size of the incentives erodes much of the tax revenue presented to the state in the form of increased economic activity, payroll, taxable income and business sales. It is up to the state to determine if the positive economic impact is worth some of the fiscal downsides of the project, given uncertainties about the firm’s viability as a private enterprise and how exactly it will claim credits”. Another consultant reported Friday that “the AEDC overestimated the long-term net economic benefits of the state’s incentives for the project and that the costs could exceed the benefits.”

The Board of Conservative Arkansas does not believe it is in the best interests of our state to incentivize another steel plant (BRS) to compete directly with a 25 year established steel plant (Nucor). Nucor came to Arkansas without any bonds being issued and without any loans being made to them by the state. They have been a good employer for the NE part of our state. We don’t see the need for another steel plant when plants in operation today already don’t have enough business to operate at or near full-capacity. And we’re concerned about the labor force. There’s the distinct possibility that Arkansas would foot the bill for the loans while Tennessee and Mississippi residents become a big portion of the labor for this new steel plant.

The Board of Conservative Arkansas believes it is simple: if BRS can afford to build their plant then they should be able to build it. If they don’t have the money, then they don’t build the plant. We do not like government getting directly involved in business, whether the company’s project is expected to be beneficial or not. Government shouldn’t pick winners and losers and our companies shouldn’t be beholden to politicians.

Arkansas needs to spend its time figuring out how to attract legitimate businesses that can afford to build their own facilities that employ Arkansans.

There are a lot of details involved, and we’ve tried to summarize as best we can. If you have questions, or want more information, please let us know. We urge our members to contact their state representative and senator with their thoughts on this project. The Joint Agriculture/Economic Development Committee begin hearings on the BRS project Monday, March 25.

Senator Jim Hendren’s Property Rights Bill, SB367, TO ADDRESS THE PROTECTION OF PRIVATE PROPERTY, has passed the Senate and is now headed to the House Judiciary Committee. Senator Hendren spoke to Conservative Arkansas about this bill at our last meeting on March 9th. It is a common sense bill that protects property owners from being run over by overreaching government regulations. More than two dozen other states have various forms of laws protecting the rights of property owners. It is time for Arkansans to be afforded similar protections. This bill will not prevent regulation or zonings of any type. It will simply ensure that no government agency can take or damage private property without compensation.

According to the House sponsor, Representative Bob Ballinger, legislators are now getting pressure from their local municipalities to kill this bill. They need to hear support from their constituents in support of private property rights. We ask that you please contact the House Judiciary Committee members in support of this bill. Remember that the House Judiciary Committee is one of the House committees that is dominated by Democrats (13 to 7) so it is more important than ever that these representatives receive a flood of emails to convince them to pass this bill to the floor.
